<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-56 <br /> <br />RESOLUTION ADOPTING A NEGATIVE DECLARATION FOR <br />THE APPLICATION OF FAIRLAND INVESTMENT, INC., <br />AS FILED UNDER CASE PDR-289/PCUP-086/PUD-81-25-6M <br /> <br />WHEREAS, Fairland Investment, Inc. has applied for conditional use permit approval of a <br />self-service gasoline station on an approximately 1.25-acre site located at <br />3121 Bernal Avenue and 3581 Utah Street consisting of eight fuel dispensers, a <br />drive-through carwash, a 3,600-square-foot convenience market, and a <br />modification to the Stanley Business Park PUD development plan to allow <br />alcoholic beverage sales from the convenience market; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - Commercial) <br />District; and <br /> <br />WHEREAS, at its meeting of September 8, 2004, the Planning Commission received and <br />reviewed the Initial Study, the proposed Negative Declaration for <br />Case PDR-l 89/PCUP-86/PUD-8 1-25-6M, and the recommendations of staff; <br />opened the public hearing and took public testimony; and continued the public <br />hearing; and <br /> <br />WHEREAS, at its meeting of September 22, 2004, the Planning Commission took further <br />public testimony at the continued public hearing; and <br /> <br />WHEREAS, the public was given the opportunity to comment on the enviromnental impacts of <br />the proposal; and <br /> <br />WHEREAS, the Planning Commission has reviewed the potential impacts in accordance with <br />the applicable state and local guidelines governing the preparation of Negative <br />Declarations; and <br /> <br />WHEREAS, the Planning Commission finds that approval of the proposed project would not <br />have any significant adverse effects on the environment; and <br /> <br />WHEREAS, the Planning Commission further finds that the proposed project will have no <br />potential for adverse impacts on the site's wildlife. <br /> <br />- <br />
