<br />Resolution No. PC-2004-55 <br />Page Two <br /> <br />2. The proposed location ofthe conditional use and the conditions under which it would <br />be operated or maintained will not be detrimental to the public health, safety, or <br />welfare, or materially injurious to the properties or improvements in the vicinity. <br /> <br />The front courtyard provides direct access to each tenant suite. Thus, the operation of <br />each business would not interfere with one another. In addition, classes would be held <br />inside the tenant space in an enclosed room. The noise from the lecture and classroom <br />discussion would not be audible from the adjacent tenant space; thus, it would not impact <br />the adjacent business' ability to operate. <br /> <br />As proposed, there would be two classes held each weekday: one class in the morning <br />and one class in the evening. The evening class would be held at 7:00 p.m. when the law <br />offices in the same building area are closed. The evening/night class could potentially <br />disturb the residents on the west side of Peters A venue. The project has been conditioned <br />to mitigate any future problems associated with noise and vehicles. In addition, the <br />parking lot is located to the immediate north of the subject lot. Curbside parking on <br />Peters A venue and on other nearby public streets is also available. Thus, this finding can <br />be made. <br /> <br />3. The proposed conditional use will comply with each of the applicable provisions of <br />the Zoning Ordinance. <br /> <br />Based on the proposal and the analysis on land use, noise, and parking, granting a <br />conditional use permit to the proposed use would be consistent with the City's ability to <br />regulate related zoning regulations. Therefore, this finding can be made. <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-128, the application of Patricia Cramer/World School of <br />Massage and Holistic Healing Arts for conditional use permit approval to operate <br />a massage and holistic healing arts school in an existing building located at <br />699 Peters A venue, subject to the conditions shown in Exhibit "B," attached <br />hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />'" <br /> <br />. <br />
