<br />Resolution No. PC-2004-50 <br />Page Two <br /> <br />properties, as sufficient parking spaces are currently available on the subject site. In <br />addition, the condition of approval requires the applicant to mitigate any nuisances that <br />may occur as a result of the tutoring business. Therefore, this finding can be made. <br /> <br />2. The proposed location of the conditional use and the conditions under which it would <br />be operated or maintained will not be detrimental to the public health, safety, or <br />welfare, or materially injurious to the properties or improvements in the vicinity. <br /> <br />The proposed tutoring facility is small in scale when compared to some other tutoring <br />centers in the City. Based on the proposal, its operation would be compatible with other <br />uses in the same business park as it would be confined inside the building and as its <br />weekday practice would be limited to a group of 12 students at anyone time. In addition, <br />the subject facility is approximately 520 feet form the nearest residential property in the <br />Jensen Tract neighborhood and is separated from this neighborhood by a soundwall and <br />other buildings in the business park. The noise and traffic generated from the proposed <br />tutoring center should not impact the residential neighborhood. Additionally, adequate <br />and safe ingress and egress into and out of the site and sufficient on-site parking would <br />make the proposed use suitable for the subject site. Therefore, this finding can be made. <br /> <br />3. The proposed conditional use will comply with each of the applicable provisions of <br />the Zoning Ordinance. <br /> <br />The site's zoning regulations conditionally permit the establishment of a tutoring facility. <br />The proposed use complies with all relevant sections of the zoning ordinance. Granting a <br />conditional use permit to the applicant for a tutoring facility would be consistent with the <br />City's ability to regulate zoning as listed in the Pleasanton Municipal Code. Therefore, <br />this finding can be made. <br /> <br />WHEREAS, the Plarming Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-I13, the application of Virginia Rossi/Longshore Tutoring <br />Center, for conditional use permit to operate an after-school tutoring business in <br />an existing building located at 1020 Serpentine Lane, Suite 105, subject to the <br />conditions shown in Exhibit B, attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />... <br /> <br />- <br />
