<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-50 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF VIRGINIA ROSSI/LONGSHORE <br />TUTORING CENTER, FOR CONDITIONAL USE PERMIT, <br />AS FILED UNDER CASE PCUP-113 <br /> <br />WHEREAS, Virginia Rossi/Longshore Tutoring Center, has applied for conditional use permit <br />to operate an after-school tutoring business in an existing building located at <br />1020 Serpentine Lane, Suite 105; and <br /> <br />WHEREAS, zoning for the property is PUD-I (Plarmed Unit Development - Industrial) <br />District; and <br /> <br />WHEREAS, at its duly noticed public hearing of August II, 2004, the Plarming Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements ofthe <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Plarming Commission made the following findings: <br /> <br />I. The proposed location of the conditional use is in accordance with the objectives of <br />the zoning ordinance and the purpose of the district in which the site is located. <br /> <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and insuring that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The subject tutoring facility provides small-group tutoring sessions in an <br />enclosed area. In the past, the City has allowed similar uses in various locations in the <br />City. The subject business is currently located on Main Street and has had no land use <br />conflict with other businesses in the surrounding area. Allowing it to continue its <br />operation in another area in the same marmer would be consisted with the above-cited <br />objectives. <br /> <br />The subject site is in the Valley Business Park, which has a mix of commercial, office, <br />and other services businesses. The current tenants in the same building are <br />office-oriented businesses. Given the nature of the proposed business, its operation <br />should not interfere with other businesses in the same building or surrounding businesses' <br />ability to operate. The anticipated number of instructors and students will not generate <br />any unusual demands on the existing parking for the subject site or the surrounding <br /> <br />III <br /> <br />. <br />
