<br />Resolution No. PC.2004.49 <br />Page Two <br /> <br />as a whole. As conditioned, the proposed BMX park at Shadow Cliffs Regional <br />Recreation Area would be consistent with these objectives. <br /> <br />Shadow Cliffs is located in a Public and Institutional District and has operated as a <br />regional recreation area since 1971. The vacant de Silva parcel and surrounding quarry <br />and electrical substation uses provide an appropriate environment in which to develop the <br />BMX park use. The proposed BMX uses would be compatible with the adjacent uses <br />particularly because of its isolated location at the northwest corner of Shadow Cliffs Park. <br />The proposed conditions of approval for the project give the City the appropriate controls <br />to ensure that the operation of the use does not have any negative impacts on the <br />surrounding properties. In addition, the BMX park would provide a new recreational <br />opportunity that would benefit Pleasanton residents. The use permit for the BMX park is <br />in accordance with the objectives of the zoning district; therefore, this finding can be <br />made. <br /> <br />2. The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br /> <br />As conditioned, the proposed BMX park will not be detrimental to the public health, <br />safety, and welfare; nor will it pose a threat to surrounding properties or improvements. <br />As proposed and conditioned, the park will provide adequate parking for the anticipated <br />uses on site, and the traffic generated will not have an impact on the Level-of-Service of <br />surrounding intersections. Given the proposed activities and location of the park, the <br />proposed BMX park will not impact surrounding uses, as conditioned. Furthermore, the <br />City would be able to mitigate any future nuisances or problems that may arise. <br />Therefore, if all conditions of approval are complied with, the proposed BMX park will <br />not detrimentally impact the surrounding properties, and this finding can be made. <br /> <br />3. The proposed conditional use will comply with each of the applicable provisions <br />ofthe Zoning Ordinance. <br /> <br />The proposed Public and Institutional zoning conditionally permits park uses. The <br />proposed used complies with all provisions and requirements of the City's zoning <br />ordinance; therefore, this finding can be made. <br /> <br />WHEREAS, the Plarming Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />. <br />
