<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-49 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF THE CITY OF PLEASANTON FOR <br />CONDITIONAL USE PERMIT AND DESIGN REVIEW APPROVALS, <br />AS FILED UNDER CASE PCUP-117/PDR-390 <br /> <br />WHEREAS, the City of Pleasanton has applied for conditional use permit and design review approvals <br />to construct and operate a bicycle motocross (BMX) facility at Shadow Cliffs Regional <br />Recreation Area located at 3320 Stanley Boulevard; and <br /> <br />WHEREAS, zoning for the property is "P" (Public and Institutional) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of August 11, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations ofthe City staff <br />concerning this application; and <br /> <br />WHEREAS, in December 2002, the East Bay Regional Park District, as lead agency for the project, <br />adopted a Mitigated Negative Declaration for its Land Use Plan Amendment for Shadow <br />Cliffs Regional Recreation Area to add the approximately II-acre De Silva parcel to the <br />park, to allow an expansion to the existing water facility, and to allow the City of <br />Pleasanton to construct a bicycle motor-cross (BMX) facility; only one mitigation <br />measure, that for air quality for which the construction contractor must follow certain <br />dust control measures, was applicable to the BMX park; and <br /> <br />WHEREAS, the Planning Commission has considered the Mitigated Negative Declaration in <br />accordance with the applicable state and local guidelines governing the preparation of <br />Negative Declarations and Environmental Impact Reports. <br /> <br />WHEREAS, the Plarming Commission has determined that no substantial changes to the project or to <br />the circumstances under which the project is undertaken that involve new significant <br />environmental effects or substantially increase the severity of previously identified <br />effects, and there is no new information of substantial importance not known at the time <br />the previous Negative Declaration was adopted regarding the project or its effects, <br />mitigation measures, or alternatives; therefore, no additional environmental <br />documentation was prepared for this application; and <br /> <br />WHEREAS, the Plarming Commission made the following findings: <br /> <br />I. The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is located. <br /> <br />The objectives of the zoning ordinance include protecting existing land uses from <br />inharmonious influences and harmful intrusions, fostering harmonious, convenient <br />workable relationships among land uses, and insuring that public and private lands <br />ultimately are used for the purposes which are most appropriate and beneficial to the City <br /> <br />. <br />
