Therefore, granting of this variance would not be <br />detrimental to the public health, safety, or general welfare or materially injurious <br />to properties in the area, and this finding for the sloping plane variance can be <br />made. <br /> <br />Building Height Variance. The architecture of the existing structure complements <br />the design of the existing house when viewed from First Street and would be in <br />keeping with the character of the Downtown area. Due to the location of the <br />existing detached two-story building and that of the existing houses on the <br />adjoining properties to the north and to the east, the existing structure would not <br />be overbearing to the adjacent properties nor adversely impact the light, air, open <br />space, and views between properties. Therefore, the granting of this variance <br />would not be detrimental to the public health, safety, or general welfare or <br />materially injurious to properties in the area, and this finding for the building <br />height variance can be made. <br /> <br />WHEREAS, the Plarming Commission determined that the proposed project is consistent with <br />the appearance of the existing buildings in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Section 2. <br /> <br />Approves Case PADR-932/PV-98, the application of Jean-Luc and Maureen <br />Chatelain for administrative design review and for variances from the Pleasanton <br />Municipal Code to legalize an existing two-story accessory structure with a <br />second unit on the second floor located at 4432 First Street as follows: (1) allow <br />the building to be located approximately two feet, six inches from the side <br />(northerly) property line and approximately one foot, nine inches from the rear <br />(easterly) property line, where a minimum five-foot side yard setback and a <br />minimum ten-foot rear yard setback, respectively, are required for a detached <br />second unit: (2) allow the building to be approximately 25 feet in height where a <br />maximum building height of 15 feet is allowed for a detached accessory structure; <br />(3) allow the northern sloping roof plane to be approximately three feet from the <br />side (northerly) property line where a minimum often feet is required, subject to <br />the conditions shown in Exhibit B, attached hereto and made part of this case by <br />reference. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />... <br />
