The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The proposed after-school tutorial center would be located in a multi-tenant building where the majority ofthe businesses are office uses. Based on the proposal, the majority of the tutoring sessions would be held after 5: 15 p.m. when the office uses in the same building would be closed. In addition, the proposed after-school tutorial center offers intensive academic learning and SAT preparation sessions that would require concentration from the students. Thus, the proposed tutorial center would not be disruptive to other businesses/tenants in the same building or on the same site. Furthermore, based on the parking analysis of the staffreport, sufficient parking is available, and there is adequate and safe ingress and egress into and out of the site. Therefore, this finding can be made. 3. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance. The PUD-C zoning district conditionally permits the establishment of a private instructional/tutorial business. Granting a conditional use permit would be consistent with the City's ability to regulate related zoning regulations. Therefore, this finding can be made. WHEREAS, the Plarming Commission determined that the proposed conditional use would be compatible with the existing uses in the area. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case PCUP-125, the application of Janice Clark/STEPS Community Prep School for conditional use permit to operate an after-school private tutorial facility in an existing building located at 4625 First Street, Suite 255, subject to the conditions shown in Exhibit "B," attached hereto and made part ofthis case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time. '"
