<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-47 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF JANICE CLARK/STEPS <br />COMMUNITY PREP SCHOOL FOR CONDITIONAL USE PERMIT, <br />AS FILED UNDER CASE PCUP-125 <br /> <br />WHEREAS, Janice Clark/STEPS Community Prep School has applied for conditional use <br />permit to operate an after-school private tutorial facility in an existing building <br />located at 4625 First Street, Suite 255; and <br /> <br />WHEREAS, zoning for the property is PUD-C-O (Plarmed Unit Development - Commercial- <br />Office) District, Downtown Revitalization District; and <br /> <br />WHEREAS, at its duly noticed public hearing of July 28, 2004, the Plarming Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Plarming Commission made the following findings: <br /> <br />I. The proposed location of the conditional use is in accordance with the objectives of <br />the zoning ordinance and the purpose ofthe district in which the site is located. <br /> <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and insuring that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The proposed after-school tutorial center would provide academic instruction <br />lessons to local middle school and high school students. In the past, the City has allowed <br />similar uses to be located in the Downtown area. None of these after-school <br />tutoring-oriented businesses has created any impacts on surrounding businesses. <br /> <br />The subject site is zoned PUD-C-O (Planned Unit Development - Commercial-Office) <br />District, and it is in the Downtown Revitalization District, where it is surrounded by a <br />mix of office/commercial/personal services meso Based on the proposal, the tutorial <br />center is considered to be a quiet use as instructions would be provided at a low-volume <br />voice level, and students would focus on intensive academic tutoring. In addition, three <br />of the four scheduled tutoring sessions would be held after 5: 15 p.m. when office uses on <br />the subject site would be closed. The proposed tutoring center, therefore, would not be <br />disruptive to the neighboring businesses/tenants, and this finding can be made. <br /> <br />., - <br />
