<br />EXHIBIT "B" <br />Conditions of Approval <br /> <br />PDR-355, James Byrd <br />328 St. Mary Street <br />June 23, 2004 <br /> <br />PLANNING <br /> <br />I. Development shall be constructed substantially as shown on the development plans and <br />color/material board, including a 50-year composition roof with the highest definition, <br />marked Exhibit "A" and dated "Received" February 13, and May 14,2004" on file with <br />the Plarming Department, except as modified by the following conditions. Minor <br />changes to the plans that are not visible from public view may be allowed subject to the <br />approval of the Plarming Director iffound to be in substantial conformance to the <br />approved exhibits. Any changes to the plans that are visible form public view shall <br />require prior review and approval by the Plarming Commission. <br /> <br />2. The applicant shall obtain all building and other applicable City permits for the project <br />prior to the commencement of construction. <br /> <br />3. The developer shall pay any and all fees to which the property may be subject prior to <br />issuance of building permits. The type and amount of the fees shall be those in effect at <br />the time the building permit is issued. <br /> <br />4. This design review approval shall lapse and shall become void one year from the date of <br />approval unless a building permit is issued and construction has commenced and is <br />diligently pursued toward completion or an extension has been approved by the City. <br /> <br />5. No building permits may be issued until a Lot Line Adjustment is approved and recorded <br />which conveys the five-foot wide portion of the 641 Main Street property along the <br />eastern side property line of the 328 St. Mary Street parcel to the 328 St. Mary Street <br />property as shown on the proposed site plan. <br /> <br />6. Prior to issuance of a building permit for the project, the applicant shall submit to the <br />Plarming Director a signed letter from the adjacent property owner at 320 St. Mary Street <br />authorizing any proposed modifications to the 320 St. Mary Street building or site. <br /> <br />7. Details of the windows and window treatments, cornice( s), eaves, shaped parapet, <br />support columns, planter boxes, iron fencing and gates, exterior light fixtures, and <br />handicapped railing shall be shown on the plans submitted for issuance of building <br />permits and shall be subject to review and approval by the Planning Director prior to <br />issuance of a building permit. These elements shall be compatible with the historic <br />elements of the building and shall reflect the fine detailing associated with the <br />architectural style and period of the building. <br /> <br />1 <br /> <br />HI <br />
