The proposed location of the conditional use and the conditions under which it would <br />be operated or maintained will not be detrimental to the public health, safety, or <br />welfare, or materially injurious to the properties or improvements in the vicinity. <br /> <br />The proposed martial arts studio is small in scale when compared to other recreation <br />facilities in town. Based on the proposal, its operation would be compatible with other <br />uses in the same zoning district, as its operation would be confined inside the building <br />and as its weekday practice would be limited to a group of 12 student at anyone time. In <br />addition, the subject facility is approximately 480 feet from the nearest residential <br />property in the California Reflections neighborhood and is separated from this <br />neighborhood by Stanley Boulevard and a sound wall. The noise and traffic generated <br />from the proposed martial arts studio should not impact the residential neighborhood. <br /> <br />The subject site has two driveways to facilitate on-site circulation. A condition of <br />approval provides that parents walk their child(ren) to classes rather than drop them off <br />for the safety ofthe studio users. Therefore, this finding can be made. <br /> <br />3. The proposed conditional use will comply with each of the applicable provisions of <br />the Zoning Ordinance. <br /> <br />The PUD-C zoning district conditionally permits the establishment of a recreation <br />facility, and the proposed martial arts studio is considered a recreational use. Granting a <br />conditional use permit would be consistent with the City's ability to regulate related <br />zoning regulations. Therefore, this finding can be made. <br /> <br />WHEREAS, the Plarming Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case PCUP-114, the application of John Persinger for conditional use <br />permit to operate a martial arts studio within the existing building located at <br />3688 Washington Street, subject to the conditions shown in Exhibit "B," attached <br />hereto and made part of this case by reference. <br /> <br />Section 2. This resolution shall become effective I 5 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />'" . <br />
