<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-40 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF JOHN PERSINGER FOR <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE PCUP-114 <br /> <br />WHEREAS, John Persinger has applied for conditional use permit to operate a martial arts <br />studio within the existing building located at 3688 Washington Street; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Plarmed Unit Development - Commercial) <br />District; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 23, 2004, the Plarming Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements ofthe <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in accordance with the objectives of <br />the zoning ordinance and the purpose of the district in which the site is located. <br /> <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and insuring that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The proposed facility is a martial arts studio that offers children, adult, and <br />family-oriented programs. All activities associated with the use would be confined inside <br />the building. The proposed use is similar to the existing dance studio in the adjacent <br />tenant space. The proposed martial arts studio would be consistent with the above-cited <br />objectives. <br /> <br />The subject site is in Stanley Business Park, which it has a mix of commercial, <br />automotive, and other service businesses. The operation of the proposed martial arts <br />studio would not interfere with surrounding businesses' ability to operate. The <br />anticipated number of instructors, adults, students, and parents will not generate any <br />unusual demands on the existing parking for the subject site or the surrounding <br />properties, as sufficient parking spaces are currently available on the subject site. <br />Furthermore, for pedestrian safety reasons, no drop-off would be allowed for the <br />proposed use. Parents would be required, as a part of the contract, to walk their <br />child(ren) to classes. Therefore, this finding can be made. <br /> <br />- <br /> <br />;. <br />
