<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-39 <br /> <br />RESOLUTION APPROVING VESTING TENTATIVE SUBDIVISION MAP 5904, <br />THE APPLICATION OF CHRIS BERATLIS <br /> <br />WHEREAS, Chris Beratlis has applied for Vesting Tentative Subdivision Map approval to <br />subdivide an 8.9-acre site located at 10 Beratlis Place into 15 single-family lots <br />(14 new single-family homes plus one existing single-family home) and six <br />remainder parcels; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Plarmed Unit Development - Low Density <br />Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 9, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, an Initial Study/Negative Declaration was adopted by the City Council for <br />PUD-91-14 on February 4,1992, in conformance with the standards ofthe <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, there were no substantial changes to the project or to the circumstances under <br />which the project is undertaken that involve new significant environmental effect <br />or substantially increase the severity of previously identified effects, and there is <br />no new information of substantial importance not known at the time the Initial <br />Study/Negative Declaration was adopted regarding the project or its effects, <br />mitigation measures, or alternatives; therefore, no additional environmental <br />documentation was prepared for this application; and <br /> <br />WHEREAS, the Plarming Commission made the following findings: <br /> <br />1. The proposed map substantially conforms to the zoning <br />regulations/development plan. <br /> <br />The PUD development plan on which the proposed vesting tentative subdivision <br />is based was found by the City Council to be consistent with the Pleasanton <br />General Plan. The subdivision map and its improvements are consistent with the <br />current General Plan and with the approved development plan and, additionally, <br />satisfactorily implement the applicable conditions and requirements imposed by <br />the City Council with its approval. Therefore, this finding can be made. <br />
