<br />17. Dahlin Group shall implement an aggressive Transportation Systems Management <br />Program which targets a peak hour trip rate of .92 (maximum of25 peak hour trips per <br />hour in the AM or PM), with an overall goal of reducing the peak hour trip rate to .75 (or <br />a maximum of20 peak hour trips per hour in the AM or PM.). <br /> <br />18. The traffic generated by Dahlin Group or any tenant of the building thereafter shall be no <br />greater than that generated by an office use for a 20,241 sq. ft. building: 25 net peak hour <br />trips per hour in the morning peak hour and 25 net peak hour trips per hour in the evening <br />peak hour. <br /> <br />19. Dahlin Group or any tenant thereafter shall create a program monitoring its employee trip <br />rates and provide annual audits of its traffic and traffic management operations to the <br />City on a yearly basis noting any new increases in staff, changes in work hours, and <br />commuting patterns. Audits shall be due annually beginning one year from the start of <br />operations. City staff will review the audits to ensure that the project generates no more <br />than 25 AM or PM peak hour trips. <br /> <br />20. Dahlin Group or any tenant thereafter shall participate in all ongoing traffic programs <br />offered by Hacienda to its businesses and residents and shall participate in the City's <br />Commendable Commutes program. Participation in these programs shall also be covered <br />in the annual traffic audits provided to staff. <br /> <br />21. If, as result of a review of the audits of the applicant's/tenant's traffic management <br />operations and programs, the Planning Director determines that the maximum 25 net <br />peak-hour trips are being exceeded, then the applicant shall immediately prepare the <br />necessary traffic report required by PUD-81-30 and shall implement any necessary <br />traffic/TSM mitigations and any other measures necessary to reduce the number of <br />peak-hour trips to a maximum of25. <br /> <br />22. Any future PUD modification to require a conditional use permit for an otherwise <br />permitted use which must rely on TSM measures and traffic audits to reduce its <br />peak-hour trips to below that which would otherwise be projected based on building floor <br />area shall be applicable to the building expansion approved under this PUD design <br />review application. <br /> <br />23. The property owner or its successors in interest (owner) shall enter into an agreement <br />with the City of Pleasanton (City) to provide that: <br /> <br />a. the owner shall either not protest the establishment of an assessment district, or shall <br />affirmatively vote for the creation of the district or other mechanism to pay the <br />construction costs for the I -680/W est Las Positas Boulevard freeway interchange, or <br />alternative traffic mitigation improvement(s) selected by the City Council, <br />depending on the manner of creation of the funding mechanism; <br /> <br />3 <br />
