<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-29 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICA nON OF <br />REGIS LACHANCE FOR PUD REZONING AND DEVELOPMENT PLAN APPROVAL, <br />AS FILED UNDER CASE PUD-28 <br /> <br />WHEREAS, Regis Lachance has applied to rezone the approximately 12,400-square-foot <br />parcel at 1072 Division Street (northwest corner of Fair and Division Streets) <br />from the R-1-6,500 (Single-Family Residential) Zoning District to the PUD-MDR <br />(Planned Unit Development - Medium Density Residential) Zoning District and <br />for PUD development plan approval to construct two new single-family detached <br />homes measuring approximately 1,200 square feet and 2,557 square feet on two <br />lots measuring approximately 4,259 square feet and 8,141 square feet, <br />respectively; and <br /> <br />WHEREAS, at its duly noticed public hearing of April 28, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission recommended approval of the negative declaration <br />prepared for this project; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed rezoning is appropriate <br />for the site; and <br /> <br />WHEREAS, the Planning Commission made the following findings for the PUD development <br />plan: <br /> <br />I. The plan is in the best interests of the public health, safety, and general <br />welfare. <br /> <br />The proposed project, as conditioned, meets all applicable City standards <br />concerning public health, safety, and welfare (e.g., adequate emergency vehicle <br />access, within a five-minute response time zone for fire service, not within a <br />geologic or flood hazard zone, not on a steep slope, etc.). Adequate storm drain, <br />sanitary sewer, and water service utilities are either now present or would be <br />required to be installed by project developers to serve the new dwellings and <br />accessory structures. The project will not generate volumes oftraffic that cannot <br />be accommodated by existing City streets and intersections in the area. The <br />structures would be designed to meet the requirements of the Uniform Building <br />Code and other applicable City codes. The proposed development is compatible <br />with the adjacent uses and would be consistent with the existing scale and <br />character of the area. Therefore, the proposed PUD development plan is in the <br />best interests ofthe public health, safety, and general welfare, and this finding can <br />be made. <br />
