<br />Exhibit B <br />Conditions of Approval <br /> <br />PCUP-I06/PDR-334, Michael Zucker & AssociatesIHendrick Automotive Group <br />3744 Old Santa Rita Road <br />February 25, 2004 <br /> <br />I. The proposed use covered by this approval shall be in substantial conformance to <br />the plans, shown as Exhibit A, dated "Received February 18,2004," on file with <br />the Planning Department, except as modified by the following conditions. Minor <br />alterations may be approved by the Planning Director if found to be in substantial <br />conformance with this approval. <br /> <br />2. In the event that the applicants propose to modify the use of the property or other <br />aspects of the business operation, including the vehicle delivery schedule, the <br />modification shall be subject to the review of the Planning Director. The <br />Planning Director may approve the modification or refer the matter to the <br />Plmming Commission if judged to be substantial. <br /> <br />3. If the operation of this use permit results in conflicts pertaining to <br />traffic/circulation, lighting, noise, or other factors, at the discretion of the <br />Planning Director, this conditional use permit may be submitted to the Planning <br />Commission for its subsequent review at a public hearing. If necessary, the <br />Planning Commission may modify or add conditions of approval to mitigate such <br />impacts, such as revising the delivery schedule, or may revoke the said <br />conditional use permit approval. <br /> <br />4. The building permit plan check materials will be accepted for submittal only after <br />completion of the fifteen (l5)-day appeal period, measured from the date of the <br />approval letter, unless the project developer submits a signed statement <br />acknowledging that the plan check fees may be forfeited in the event that the <br />approval is overturned on appeal or that the design is significantly changed as a <br />result of the appeal. In no case will a building permit be issued prior to the <br />expiration of the fifteen (l5)-day time-period. <br /> <br />5. The applicant shall obtain approval from the property owners to the east <br />(Rosewood Pavilion) prior to connecting the on-site storm drain system to the <br />existing public storm drain. <br /> <br />6. Prior to issuance of a building permit, the applicant shall provide a detailed <br />bio-swale design to the Pubic Works Department for review and approval. <br /> <br />7. The construction drawings shall include details of the new sidewalk and <br />driveway, and they shall conform to the City's standard specifications. <br />
