<br />Resolution No. PC-2004-l5 <br />Page Two <br /> <br />2. The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br /> <br />The subject lot has been used as an outdoor vehicle storage yard since the East Bay <br />Automotive Company purchased the property in late 1990, and no complaints have been <br />received concerning its operation. The traffic to and from the subject lot would not <br />impact the surrounding businesses, given that the regular delivery hours are early in the <br />morning. Additionally, with the distance from the subject site and other commercial <br />buildings in between to function as a buffer, trucks traveling on Old Santa Rita Road and <br />unloading nine vehicles would not disturb the residents who reside at least 400 feet from <br />the subject lot. However, in the event that any concerns regarding traffic, circulation, and <br />noise are raised, a condition of approval has been added recommending that the vehicle <br />delivery schedule be changed. <br /> <br />To provide necessary security to the lot, new lighting would be installed. To ensure that <br />light spill would be controlled, a condition requires that the lighting system be revised to <br />lower the height of the light pole or to adjust the light fixture, or both, so that no light <br />spill would occur onto adjacent properties. The curb-to-curb width on Old Santa Rita <br />Road is 64 feet; thus, delivery trucks traveling on Old Santa Rita should not impact the <br />use of the street for adjacent businesses. In addition, a new sidewalk would be installed <br />along the Old Santa Rita Road frontage, which would provide a safer environment to the <br />public. Thus, the proposed use will not be detrimental to the public safety and general <br />welfare, and this finding can be made with the proposed conditions of approval. <br /> <br />3. The proposed conditional use will comply with each ofthe applicable provisions <br />of the Zoning Ordinance. <br /> <br />As conditioned, the proposed use will comply with all provisions and requirements of the <br />City's zoning ordinance. As with any conditional use permit, the use permit may be <br />suspended or revoked if the conditions are not met. Therefore, this finding can be made <br />with the proposed conditions of approval. <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-I07/PDR-349, the application of Michael Zucker & <br />Associates/Hendrick Automotive Group for conditional use permit and design review <br />approvals to operate an outdoor vehicle storage yard for the property located at 3744 Old <br />Santa Rita Road, subject to the conditions shown in Exhibit "B," attached hereto and <br />made part of this case by reference. <br />
