<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-15 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF MICHAEL ZUCKER & <br />ASSOCIATES/HENDRICK AUTOMOTIVE GROUP FOR CONDlTIONAL USE PERMlT AND <br />DESIGN REVlEW APPROVALS, AS FILED UNDER CASE PCUP-107/PDR-334 <br /> <br />WHEREAS, Michael Zucker & Associates/Hendrick Automotive Group has applied for conditional <br />use permit and design review approvals to operate an outdoor vehicle storage yard for the <br />property located at 3744 Old Santa Rita Road; and <br /> <br />WHEREAS, zoning for the property is C-S (Service-Commercial) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of February 25, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements of the California <br />Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in accordance with the objectives <br />of the zoning ordinance and the purpose of the district in which the site is located. <br /> <br />The objectives stated in the zoning ordinance include fostering harmonious, convenient, <br />workable relationship among land uses, protecting land uses from inharmonious <br />influences and harmful intrusions, and insuring that public and private lands are used for <br />the purposes which are most appropriate and beneficial to the City as a whole. The <br />proposed outdoor vehicle storage use is located on Old Santa Road, an area where the <br />majority of the existing commercial businesses are service-/repair-oriented commercial <br />businesses that store business suppliers and equipment in the open area. The subject lot <br />was once used as an outdoor storage yard for a cable company. Continuing to use the <br />subject site as an outdoor storage yard for vehicles would be similar to the previously <br />approved storage yard for a cable company. In addition, although operating without use <br />permit approval, the subject site has been used in the past years as an outdoor vehicle <br />storage yard, and staff has not receive any complaints regarding its operation. If <br />managed in a same manner as it currently is, the outdoor vehicle storage use would be <br />consistent with the above-cited objectives. With the proposed on-site and off-site <br />improvements, such as a new storm drain system, new sidewalk per City standards, and <br />new landscaping, the conditions and appearance ofthe subject lot would be improved <br />significantly, and the proposed improvement would make the lot suitable for the use. <br />Thus, the proposed use would be in accordance with the object of the zoning ordinance <br />and the purpose of the district in which the site is located, and this finding can be made. <br />
