The design of the subdivision or the type of improvements do not conflict with <br />easements for access through or use of the property. <br /> <br />The project design does not conflict with any easements for access through or use of the <br />property. The subdivision is providing access to all parcels, including the existing <br />residence, pursuant to the Specific Plan and PUD. The existing four-foot wide PG&E <br />easement along the western edge of the property will remain. Therefore, this finding can <br />be made. <br /> <br />8. The restriction on approving a tentative subdivision map on land covered by a <br />contract entered into pursuant to the California Land Conservation Act of 1965 is <br />not applicable. <br /> <br />The site is not covered by such a contract. <br /> <br />9. The discharge of waste from the proposed subdivision would not result in <br />violation of existing requirements prescribed by the California Regional Water <br />Quality Control Board (CRWQCB) <br /> <br />No violation currently exists at the wastewater treatment plant. Capacity is available for <br />this subdivision. In addition, the expansion of both the wastewater treatment plant and <br />the Livermore Amador Valley Waste Management Authority export pipeline are likely to <br />be completed by the time this subdivision is occupied. The project would not discharge <br />any waste other than domestic sewage. Urban stormwater runoff is required to meet the <br />City's CRWQCB permit requirements for urban development. <br /> <br />WHEREAS, the Planning Commission has determined that the proposed subdivision is in keeping <br />with the requirements of the previously approved PUD development plan. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Approves Vesting Tentative Tract Map 7505, the application of Keith Kaas for Vesting <br />Tentative Tract Map approval for five single-family lots and related infrastructure within <br />a 4.49-acre parcel containing the existing Kass residence located at 966 Sycamore, <br />subject to the conditions shown in Exhibit "B," attached hereto and made part of this case <br />by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption unless <br />appealed prior to that time. <br />
