<br />Resolution No. PC-2004-14 <br />Page Two <br /> <br />3. The subdivision, together with its design and improvement, is consistent with the <br />General Plan. <br /> <br />The PUD was found to be consistent with the General Plan, and this subdivision is based <br />on and consistent with that development plan. As proposed, the subdivision is <br />compatible with the objectives, policies, land uses, and programs specified in the General <br />Plan. Therefore, this finding can be made. <br /> <br />4. The subdivision site is physically suitable for the type and density of <br />development. <br /> <br />The site would be contour graded with the flat pad areas of the different lots stepping <br />down the slope towards Sunset Creek Lane. The geotechnical studies have found the site <br />suitable for development with only normal issues for foundations, etc. The planned <br />grading will create minimum slopes to control runoff and allow gravity utilities (sewers, <br />storm drains) to function. The North Sycamore Specific Plan, with which this project is <br />consistent, addressed the developability of this site and determined the appropriate <br />density for this site; the proposed project is less than the density allowed pursuant to the <br />Specific Plan and has been designed to minimize issues with adjacent properties. <br />Therefore, this finding can be made. <br /> <br />5. The design of the subdivision and improvements are not likely to cause <br />substantial environmental damage or substantially and avoidably injure fish or <br />wildlife in their habitat. <br /> <br />Pretreatment of urban storm water runoff is built into the project's design through the use <br />of swales on Lot 5. A condition of approval has been added requiring vegetated swales <br />to be used in the final grading and landscape design of Lots I through 4 to provide storm <br />water pretreatment on these lots. Best management practices are required to minimize <br />construction stage impacts. All environmental issues were addressed in the EIR for the <br />North Sycamore Specific Plan, and measures to mitigate any impacts have been <br />incorporated into the development. Therefore, this finding can be made. <br /> <br />6. The design of the subdivision or type of improvements is not likely to cause <br />serious public health problems. <br /> <br />The subdivision is designed to be served by all City utilities and services at established <br />service levels. Full water and sewer service is included. The street design keeps street <br />traffic at satisfactory residential street volumes. The site is free from any toxic or <br />hazardous materials. No earthquake, landslide, flooding, or other natural hazards exist at <br />this site at a level deemed "unacceptable" in the General Plan. Therefore, this finding <br />can be made. <br />
