Exhibit B Conditions of Approval PCUP-I04, Noel Remigio 500 Boulder Court January 28, 2004 I. The location and operation of the proposed use shall conform substantially to Exhibit "A" (the site plan, floor plans, and details of operation), dated "Received, December 12,2003," on file with the Planning Department, except as modified by the following conditions of approval. Minor changes to the approved operation and schedule may be approved by the Planning Director if found to be in substantial compliance with the proposal. 2. The operation of the indoor volleyball training facility shall generally adhere to the following schedule: Sept. I - June 15: Mon. - Fri.: 4:00 p.m. to 9:00 p.m.(school days) Sat. - Sun.: 10:00 a.m. to 9:00 p.m. June 16 - Aug. 31: Mon.-Fri.: 8:00 a.m. to 9:00 p.m.(non-school days) Sat. - Sun.: 10:00 a.m. - 9:00 p.m. 3. If additional hours and activities beyond what was stated in the applicant's statement of operation, dated "Received December 12, 2003," on file in the Planning Department, are desired, prior City review and approval is required. Such modification may be approved by the Planning Director if found to be in substantial conformance with he approval. The Planning Director may also refer the matter to the Planning Commission if the proposed changes would be significant. 4. The facility operator shall notify facility users and visitors to park only on the subject lot by providing them with a flyer and site map indicating the boundaries of the site and specifying the parking spaces which can be used by facility users. The flyer shall include language that no vehicles shall block any driveways. A copy of the notification shall be provided to all facility users and the Planning Department within thirty (30) days from the date of this approval. 5. The proposed facility is restricted for training purposes. At no time shall any competition or exhibit games be held at the subject location. 6. If operations of this use permit results in conflicts pertaining to parking, interior noise, traffic/circulation, or other factors, at the discretion of the Planning Director, this conditional use permit may be submitted to the Planning Commission for its subsequent review at a public hearing. If necessary, the Planning Commission may modify or add conditions of approval to mitigate such impacts or may revoke the said conditional use permit approval.
