Chairperson Roberts advised that some of the language in the first paragraph on page 12 <br />was attributable to Commissioner Maas. <br />The minutes were approved as corrected. <br />3. MEETING OPEN FOR ANY MEMBER OF THE AUDIENCE TO <br />ADDRESS THE PLANNING COMMISSION ON ANY ITEM WHICH IS <br />NOT ALREADY ON THE AGENDA. <br />Kevin Close, 871 Sycamore Road, noted that the Happy Valley community met with <br />Greenbriar Homes on Monday to discuss the proposed Spotorno Flat Area project. There <br />was considerable concern voiced at the meeting about the future supplemental EIR <br />scoping session. Greenbriar indicated that it would be within the next 30 days, and he <br />would like to ensure the community would be noticed. <br />Chairperson Roberts replied that there were two more Planning Commission meetings in <br />2004, and Ms. Kline had not heard that it would be scheduled within the next 30 days. <br />She would follow-up on the schedule and report back to the Commission. <br />In response to an inquiry by Commissioner Arkin regarding the notification, Ms. Kline <br />confirmed that the City normally noticed property owners and occupants within a <br />1,000-foot radius of larger projects and also noticed beyond the 1,000-foot radius to <br />_ ensure that entire neighborhoods were given the opportunity to comment on the proposed <br />project. She noted that staff would send notices to all residents in the Happy Valley <br />Specific Plan Area for the Spotomo scoping session. <br />Chairperson Roberts advised that the Commission would not meet the evening before <br />Thanksgiving. <br />Vanessa Kawaihu, 871 Sycamore, wished to address the Greenbriar community scoping <br />session and noted that the Happy Valley community did sue the City of Pleasanton. She <br />noted that the community lost the lawsuit and added that the judge found that the original <br />Happy Valley Specific Plan included the upper Bypass Road. She noted that what <br />Greenbriar brought forward did not include that upper Bypass Road and added that many <br />in the community were very concerned. She noted that on January 21, 2003, the <br />Pleasanton City Council passed Resolution 03-008 which called for a study of the upper <br />Bypass Road, as designated in the Happy Valley Specific Plan. She noted that no study <br />of that road had been performed, and the resolution was referenced twice in the judge's <br />findings. She expressed concern that the developer working with the Spotorno family <br />may have performed an end run azound the court and the community by suggesting a <br />different road and a higher density than what the Specific Plan called for. <br />In response to an inquiry by Commissioner Fox whether any Planning staff had attended <br />that meeting, Ms. Kline replied that they had not and that staff was unaware that the <br />meeting had been held. <br />PLANNING COMMISSION MINUTES; October 27, 2004 Page 2 of 12 <br />
