_ Chairperson Roberts advised that she was having trouble overturning a 1996 PUD that <br />divided the original property into 12 separate lots. She noted that she had driven down <br />Ohana Place and believed that the houses were very close together. She believed that the <br />setbacks and positioning of the house would be difficult for Lot 1. She had difficulty <br />making a planning decision based on a retirement necessity. <br />Commissioner Fox noted that she would agree with Chairperson Roberts's assessment if <br />the lots were less than 15,000 square feet, but she had no problem with staff's <br />recommendation. She did not believe this application was out of character for the <br />neighborhood. <br />Commissioner Maas agreed with Commissioner Fox's assessment. <br />Following Commissioner Arkin's request for clazification regarding the lot sizes and <br />density limitations, a discussion of the lot sizes and zoning ensued. Mr. Iserson <br />explained that staff needed to go through the step of modifying the Specific Plan, but felt <br />that it was a minor change that did not undo the intent of the Specific Plan. Staff <br />believed that there would still be fewer units that were originally anticipated with the <br />Specific Plan due to fewer units approved on other properties. <br />Commissioner Maas moved: (1) to find that the Specific Plan modification is <br />exempt from CEQA as a minor alteration to land use regulations; that there are no <br />new or changed circumstances which require additional CEQA review of the <br />project; that the Specific Plan modification is consistent with the General Plan; that <br />the amendment to the North Sycamore Specific Plan, IV. Land Use Element, <br />A. Land Use Summary, paragraph 1 shall be amended presented in the staff report; <br />that the PUD major modification is consistent with the PUD findings presented in <br />the staff report; and that the PUD major modification is consistent with the General <br />Plan and the North Sycamore Specific Plan as described in the staff report; and <br />(2) to recommend approval of PSP-6/PUD-96-4-1M, the Specific Plan and the PUD <br />major modification, subject to the conditions of approval as shown on Exhibit "B" <br />of the staff report. <br />Commissioner Fox seconded the motion. <br />ROLL CALL VOTE <br />AYES: Commissioners Arkin, Fox, Maas, and Roberts. <br />NOES: None. <br />ABSTAIN: None. <br />ABSENT: Commissioners Kameny and Sullivan. <br />RECUSED: None. <br />Resolution No. PC-2004-53 was entered and adopted as motioned. <br />PLANNING COMMISSION MINUTES August 25, 2004 Page 4 of 9 <br />
