He reiterated his request to operate the <br />carwash on a limited basis until the fence is installed. <br />THE PUBLIC HEARING WAS CLOSED. <br />The Planning Commission recessed for a break at 9:00 p.m. <br />Commissioner Arkin reconvened the meeting at 9:05 p.m. <br />Commissioner Sullivan presented his recollection of the development and approval <br />process of the Bernal Property, emphasizing his original opposition to the establishment <br />of the commercial center. He stated that the site was afreeway-oriented rather than <br />neighborhood-oriented development and that the carwash, the drive-through, and the <br />24-hour service station and convenience store were not compatible with the <br />neighborhood. He indicated that he was in favor of reducing the hours of operation, <br />curtailing or eliminating the carwash and drive-through, and removing the walkway to <br />the center. He noted that aneight-foot tall fence would solve the noise issue and <br />expressed concern regarding its aesthetics and visibility at the gateway to the community. <br />Commissioner Fox stated that she was in favor of reduced hours of operation and the <br />installation of a landscaped masonry wall rather than a wood fence. She expressed <br />concern regarding safety issues of the carwash and improving the quality of life for the <br />neighbors. She added that while she was not particularly in favor of the drive-through <br />_ and carwash, she did not want to revoke the use permit without first trying other things. <br />Commissioner Arkin indicated that he could support the reduction of the hours of <br />operation but not the elimination of some of the uses. He was in favor of installing an <br />eight-foot tall fence and suggested that the design be similar to the masonry wall along <br />the eastern end of Stoneridge Drive. He expressed concern about safety issues in the <br />carwash and suggested that a motion sensor be installed such that any unauthorized use of <br />the carwash such as children entering the area would set off an alarm. He proposed that <br />the parking restrictions be enforced along the residential streets to prevent trucks and <br />buses from parking there. <br />After discussing the various measures proposed by staff to mitigate the neighborhood <br />issues caused by the operation of the service station, the Commissioners took a straw vote <br />and agreed on the following: <br />• Self-service gasoline station and convenience market to remain open 24 hours. <br />• An eight-foot tall masonry wall with landscaping matching the design of the wall <br />along the eastern end of Stoneridge Drive at Newton Drive, to be constructed on <br />the east and south sides of the site, generally from the entrance to the carwash to <br />the exit of the Jack-in-the-Box drive-through. <br />• Jack-in-the-Box drive-through hours to be limited to 7:00 a.m. to 10:00 p.m. on <br />weekdays and 9:00 a.m. to 10:00 p.m. on weekends; removable bollards to be <br />placed at the drive-through entry at close of drive-through service; employee on <br />- duty to keep signed daily log of times when bollards are set up. <br />PLANNING COMMISSION MINUTES July 28, 2004 Page 9 of 19 <br />
