_ Mr. Otto advised that an e-mail had been received from a resident at 418 St. Mazy's Street <br />expressing concerns if a bar or pub were established in this building. Staff informed the <br />neighbor that this application would not include the approval of any uses and that a proposed bar <br />in this located would require a separate use permit approval by the Planning Commission. <br />Staff believes that the building and site modifications have been attractively designed and would <br />fit in well with the historic Downtown Pleasanton. Staff recommended approval of this <br />application and the certificate of appropriateness to modify the building, subject to the conditions <br />in Exhibit B, with the modification to Condition No. 12. <br />In response to an inquiry by Commissioner Kameny regazding the pedestrian walkway, Mr. Otto <br />confirmed that the west side had the City's driveway, which may also be a pedestrian use. The <br />east side of the building had a narrow passageway, and the gates would be closed after hours. <br />THE PUBLIC HEARING WAS OPENED. <br />Robert Byrd noted that he would represent his brother James, who owned the building, and they <br />had agreed to the 71 conditions in the staff report. He took issue with the roof, stating that they <br />were not interested in installing a steel roof because of the quality of its appearance. <br />In response to an inquiry by Commissioner Arkin, Mr. Byrd replied that they planned to use the <br />highest quality roof materials by installing a 50-year presidential shake roof. He added that <br />appearance, rather than money, was the important issue to them. Commissioner Arkin indicated <br />that he wanted more information about the flags and that any sign program would still need <br />approval. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Arkin moved to approve PDR-355 as conditioned in the staff report, with <br />the following modifications: <br />1. Include the three drawings received by the Planning Commission as part of <br />Exhibit A, which included the 50-year presidential shake roof; <br />2. Add a condition that any change visible from public access shall be subject to the <br />Planning Commission's review and approval; and <br />3. Delete the word "concrete" from Condition No. 12. <br />Commissioner Sullivan seconded the motion. <br />ROLL CALL VOTE <br />AYES: Commissioners Arkin, Kameny, Maas, Roberts, and Sullivan. <br />NOES: None. <br />ABSTAIN: None. <br />ABSENT: None. <br />Resolution No. PC-2004-41 was entered and adopted as motioned. <br />PLANNING COMMISSION MINUTES June 23, 2004 Page 8 of 15 <br />
