City of Pleasanton Inclusionarv Zoning Ordinance <br />Review of the Inclusionary Zoning Ordinance to determine its effectiveness and <br />any potential changes needed to assure that the ordinance is facilitating in the <br />City's affordable housing priorities. The Inclusionary Zoning Ordinance, adopted <br />by the City Council in November, 2002, establishes criteria for providing <br />affordable housing in new housing developments. <br />This item was continued to the Planning Commission meeting of June 23, 2004. <br />7. MATTERS INITIATED BY COMMISSION MEMBERS <br />a. Discussion of "Vision Pleasanton" brochure. <br />This item was continued to the Planning Commission meeting of June 23, 2004. <br />Day Care Facility for Disabled Children at Valley Trails Drive <br />Commissioner Fox wished to discuss a facility operated out of a home on Valley Trails <br />Drive to which the Regional Center of the East Bay referred disabled children, mainly <br />under the age of three for speech and other therapies. The facility is called "Happy <br />Talkers" and is operated by Chazlene and Mitch Sigman. She noted that this facility was <br />partially funded by the State Department of Developmental Services under the Lanterman <br />Act and added that an azticle had been published about the home-based facility in the <br />Pleasanton Weekly in September, 2003. She noted that four to six children were served <br />in the facility at a time. After the children reach the age of three, the School District <br />often keeps the students from Pleasanton in the facility. She noted that she understood <br />that the facility was visited by a new Code Enforcement Officer approximately two-and- <br />a-half weeks ago following a complaint from a City employee who had discovered that <br />there were some zoning issues regazding the number of children on-site. <br />In subsequent conversations, the Sigmans relayed to Commissioner Fox that they <br />believed they were told by the new Code Enforcement Officer, who is on vacation until <br />June 14, 2004, that they must close. They also believed that they would not be able to <br />operate the facility in Pleasanton in the future and planned to move to Dublin. The <br />Sigmans had been in business for four years in that location. She added that Brian Swift< <br />Planning Director, had not been awaze of this situation and had indicated that there were <br />lazge day care facilities (7 to 12 or 14 children) within the City zoned in residential azeas. <br />She noted that this facility was licensed by the State. She noted that the Sigmans were <br />unable to get a large day caze facility zoning permit because they must get permission <br />from the property owner, who has been very wary of further involvement because of the <br />enforcement action. <br />PLANNING COMMISSION MINUTES June 9, 2004 Page 15 of 19 <br />
