and the same is hereby fixed as the day, hour and place when and <br /> where any and all persons in~erested in ~he proposed vacation of <br /> easement for sewer right of way and havinZ any objections to the <br /> proposed vacation may appear before the said City Council of the <br /> Town of Pleasanton and show cause why such sewer easement as <br /> described above should not be vacateale <br /> <br /> The above date for hearinZ of protests shall not be <br /> less than fifteen (15) days from the passage of this ordinances <br /> _SECTION ~= On the day fixed for the hearin~ of persons interested <br /> the City Council shall fin~ from all the evidence submitted, wheth, <br /> or not said easement is necessary for present or prospective publi, <br /> uses <br /> <br />_S,ECTION 6: Should the City Council find, from all ovidenos <br />submitted, that said easement is not necessary for present or <br />prospective public use, then the City Council may by resolution du <br />introduced and passed, make its order vacating all of said easemen <br />8ECTION,_Zl The City Council initiates this proceedin~ upon its <br />initiative and does hereby set forth its reasons for desirin~ the <br />proposed vacation as follows= (1) That a similar and nearby <br />easement in Tract 128~ in ~he Town of Pleasanton has been dedicate~ <br />to the Town and accepted by the TownI (2) That no sewer <br />facilities of Tract 1284 will be located in the sewer right--of-way <br />proposed to be vacated hereby; and (~} that the City Engineer has <br />approved said vacations <br /> <br /> ~ECTION 8 ~ The City Clerk of the Town of Pleasanton shall cause <br />at least three (~) copies of this ordinance to be posted not more <br />than three hundred (~00~ feet apart, along the line of the easemen4 <br />proposed to be vacated, <br /> <br />SECTION 9: The City Clerk of the Town of Pleasanton shall cause <br /> <br />a copy of this ordinance to be published in The Pleasanton Times, <br /> <br /> <br />
