We can only assume that our willingness in the <br />past to be accommodating and fi'iendly has been misunderstood. We ask only that <br />cooperation be mutual. <br /> <br />We hope this misunderstanding will be resolved by the following account of the events: <br /> <br />1. I made an agreement with Green briar that instead of paying me cash for the <br />right- away through my property to build Sycamore Creek way, I would like them <br />to: <br /> o Manage the project and build a private road to where my house would be <br /> located at. <br /> o Extend the services to that location and the new lot just below my house. <br /> <br />· 2. During the design I met with you, since the portion up to the location of your <br /> old water tower, where your well is currently located at, of this private road was <br /> shared with you, to review the design portion that impacts you. <br />· 3. That portion of road would have been straddling our property joint property <br /> line equally. <br />· 4. You asked to put more of the road on my property since the moving of your <br /> buildings fomed upon you by Green briar would not leave enough room for your <br /> rental units, and you needed the income. <br />· 5. In remm you would allow me to put portion of the road servicing my lots <br /> beyond your well on your property. I agreed to do so. <br />· 6. I asked if you would want to jointly develop the road to serve both our <br /> properties aRer sub-division. <br />· 7. You told me you do not have any plans to sub-divide for at least Twenty years. <br /> "This land is for my young kids, at the time toddlers, college tuition". <br />· 8. You later repeated the same statement in the City of Pleasanton public hearing. <br />· 9. I was not successful in getting the City Staff to drop the idea about the <br /> Pedestrian Path. <br />· 10. You also expressed concern about the Pedestrian path, since you were <br /> concerned about pedestrians spooking your homes. <br />· 11. As City staffpushed me to put in the pedestrian path all the way to San <br /> Carlos way against my opposition and yours. You came up with the idea of <br /> putting a portion of the path on your property. <br />· 12. In combination with your idea, City staff suggested a language to be placed in <br /> my PUD (CONDITIONS OF APPROVAL, Planning # 8) "The construction of <br /> the pedestrian path on the Bach property shall be the responsibility of the <br /> <br />Page 1 <br /> <br /> <br />
