Regarding the proposed development plan, a motion was made and seconded to recommend ap- <br />proval of case PUD-42 per staff with modifications pertaining to design review procedures, open <br />fencing, and the Greenes' concerns regarding retaining walls, runoff and flooding, fence design, <br />and their right-to-farm. It passed on a 3-0-2 vote (Commissioners Blank, Fox, and Roberts - <br />Aye, Commissioners Arkin and Maas - Absent. The changes recommended by the Planning <br />Commission are incorporated into the draft ordinance. <br /> <br />PUBLIC COMMENT <br /> <br />Notices of the City Council's public hearing on this item were sent to the home owners located <br />within 1,000-feet of the subject property and living on San Carlos Way, San Juan Way, San Luis <br />Court, and Sonoma Drive. Previous letters and email communications from the surrounding <br />neighbors are attached. Staffhas not received any additional verbal or written comments pertain- <br />ing to the proposed project as of the time that the City Council staff report was written. <br /> <br />PUD DEVELOPMENT PLAN FINDINGS <br /> <br />The Pleasanton Municipal Code sets forth thc purposes of the Planned Unit Development (PUD) <br />District and the considerations to be addressed in reviewing a PUD development plan proposal. <br />The City Council must make the findings that the proposed PUD development plan conforms to <br />the purposes of the PUD District, before making its action. The attached Planning Commission <br />staff report contains the PUD development plan findings for this application. <br /> <br />FISCAL IMPACT <br /> <br />The project developer would install a public sidewalk connection required by the North Syca- <br />more Specific Plan, a public amenity, and would be required to pay the development fees speci- <br />fied by the PUD development plan. The sidewalk would be maintained by the City. Future <br />homeowners would pay property taxes that would go to offset their impact to City services in- <br />cluding police, fire, support staff, etc. <br /> <br />CITY COUNCIL OPTIONS <br /> <br />The City Council has the following options pertaining to this application: <br /> <br />Deny the proposed amendment to the North Sycamore Specific Plan and approve the pro- <br />posed project: <br /> <br />This option would maintain the Specific Plan requirement for the sidewalk connection. <br />With this option the Council can approve the project as proposed or with any modifica- <br />tions to design, conditions of approval, etc., that the City Council deems to be appropriate. <br /> <br />SR 05:069 <br />Page 11 of 15 <br /> <br /> <br />
