<br />Resolution No. PC-96-99 <br />Page 4 <br /> <br />EXHIBIT "B" <br />Vesting Tentative Map 6902 <br /> <br />1. Development shall be substantially as shown on the Vesting Tentative Tract Map, Exhibit <br />"A", dated "Received, December 6,1996" on file with the Planning Department, except <br />as modified by these conditions. Minor alterations may be approved by the Planning <br />Director if found to be in substantial compliance with this approval. <br /> <br />2. All conditions of approval for PUD-96-9 shall remain in effect and in full force and are <br />herein incorporated by reference. <br /> <br />3. The developer shall submit the design of the retaining wall to be constructed in the <br />Arroyo Del Valle for review and approval by the Planning Director in conjunction with <br />the arroyo trail plan and the final map. In general, the retaining wall should feature a <br />crib-lock type of block; if constructed of concrete, it shall be a natural earth tone color. <br />The wall system shall incorporate graffiti maintenance removal materials or finishes. <br /> <br />4. The developer shall submit final improvement plans for the Arroyo Del Valle trail to the <br />City in conjunction with the final map for review and approval by the City Engineer and <br />Planning Director. Construction of the trail shall begin with the development's first <br />construction phase. <br /> <br />5. This vesting tentative map is conditionally approved and shall only become effective if <br />this project receives growth management approval within one (1) year ofthe date the <br />vesting tentative map is conditionally approved. This conditional approval shall lapse if <br />the developer fails to record a final map prior to the expiration of the growth management <br />approval. <br /> <br />6. The developer shall submit an undergrounding plan for the existing overhead electrical <br />line to the City Engineer for review and approval in conjunction with the final map. <br /> <br />7. The developer shall make a good faith effort in securing the necessary area from the <br />current property owner(s) located along the south project boundary line to allow for the <br />construction of the bank stabilization measures required by the Alameda Water Quality <br />and Flood Control District Zone 7. In the event that the developer is unable to obtain the <br />required area, the City shall assist the developer as needed in obtaining the necessary <br />area. The area shall be secured prior to project construction. <br /> <br />8. The developer shall complete the required bank stabilization work in the Arroyo Del <br />Valle before issuance of the first occupancy permit for this project. <br />
