The design of the subdivision and proposed improvements will not cause <br />substantial environmental damage or substantially and avoidably injure <br />fish or wildlife or their habitat. <br /> <br />The developer will construct minor improvements within the Arroyo Del Valle <br />limited to the installation of a creek trail and, if feasible, rock to stabilize portions <br />of the existing creek bank. The proposed improvements are minor in scale and <br />will not cause environmental damage or substantially and avoidably injure fish or <br />wildlife or their habitat. <br /> <br />4. The design of the subdivision is not likely to cause serious public health <br />problems. <br /> <br />All improvements within the subdivision would be designed and built to City <br />standards for water, sewer, storm drainage, and access/circulation. Therefore, <br />staff believes that this finding can be made. <br /> <br />5. The design of the subdivision or its related improvements will not conflict <br />with easements, acquired by the public at large, for access through or use of <br />property within the proposed subdivision. <br /> <br />There is an existing storm drain easement along the easterly side of the subject <br />site which is a utility easement not affecting/affected by the proposed <br />development. <br /> <br />WHEREAS, the Planning Commission determined that the proposed tentative map is <br />consistent with the approved PUD development plan. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case Tract 6902, the application of Pat co International, Inc., for vesting <br />tentative map approval to subdivide an approximately 1.66-acre site into 11 <br />residential lots, one common area parcel, and one parcel to be dedicated to Zone 7 <br />located at 4110 Del Valle Parkway, between Del Valle Parkway and the Arroyo <br />Del Valle, subject to the conditions shown in Exhibit "B," attached hereto and <br />made part ofthis case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
