The design of the subdivision and proposed improvements will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. The developer will construct minor improvements within the Arroyo Del Valle limited to the installation of a creek trail and, if feasible, rock to stabilize portions of the existing creek bank. The proposed improvements are minor in scale and will not cause environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 4. The design of the subdivision is not likely to cause serious public health problems. All improvements within the subdivision would be designed and built to City standards for water, sewer, storm drainage, and access/circulation. Therefore, staff believes that this finding can be made. 5. The design of the subdivision or its related improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. There is an existing storm drain easement along the easterly side of the subject site which is a utility easement not affecting/affected by the proposed development. WHEREAS, the Planning Commission determined that the proposed tentative map is consistent with the approved PUD development plan. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case Tract 6902, the application of Pat co International, Inc., for vesting tentative map approval to subdivide an approximately 1.66-acre site into 11 residential lots, one common area parcel, and one parcel to be dedicated to Zone 7 located at 4110 Del Valle Parkway, between Del Valle Parkway and the Arroyo Del Valle, subject to the conditions shown in Exhibit "B," attached hereto and made part ofthis case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
