The proposed location ofthe conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The proposed therapeutic massage facility would be contained completely on-site. Sufficient parking and traffic capacity have been provided. Professional massage facilities tend to be quiet and do not subject surrounding uses to heavy traffic, hazardous odors, or other objectionable influences. Other similar uses in the city have not caused any problems. Additionally, massage practitioners must register their businesses with the Pleasanton Police Department. This additional review process helps to identity any potentially significant issues related to the health, safety, or welfare of the general public. The conditions of project approval will ensure that the establishment of this business remain within the standards of all applicable City codes. C. The proposed conditional use will comply with each ofthe applicable provisions of this chapter. The site's PUD-C zoning conditionally permits the establishment of massage facilities. In addition, the proposed use complies with all relevant sections of the zoning ordinance. Granting a conditional use permit to the applicants to operate a therapeutic massage facility is consistent with the City's ability to regulate zoning as listed in Municipal Code Section 18.124 "Conditional Uses." WHEREAS, projectsofthis nature are categorically exempt from the requirements ofthe California Environmental Quality Act (CEQA); therefore, no environmental document was prepared for this project. WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will be compatible with the surrounding uses and neighborhood. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-96-70, the application of Pam Danforth and Jane Perkins, for a conditional use permit to operate a massage therapy office at 1811 Santa Rita Road, subject to the conditions shown in Exhibit "B," attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
