<br />Resolution No. PC-96-85 <br />Page 7 <br /> <br />13. The developer shall disclose the following items to prospective purchasers of this devel- <br />opment: <br /> <br />a. The location of the Livermore Airport, aircraft operational levels, and projected <br />noise levels. <br /> <br />b. The planned extension of Stoneridge Drive across the Arroyo Mocho to El Charro <br />Road. <br /> <br />c. The probable future use of the Kaiser Sand and Gravel quarry as a regional recrea- <br />tion area similar to Shadowcliffs, that the existing berm/mound separating the pro- <br />ject site from the quarry may be removed, and that a pedestrianlbicycle/equestrian <br />trail may be installed in the area located between this site and the quarry property. <br /> <br />The disclosure shall be submitted to the City Attorney for review and approval before <br />issuance of building permits. <br /> <br />14. The applicant shall record CC&R's at the time of recordation of the final map which shall <br />create a property owners association for the development. The CC&R's shall be subject <br />to the review and approval of the City Attorney prior to recordation of the final map. The <br />CC&R'S shall include the following items: <br /> <br />a. The property owners association shall be responsible for maintenance of all private <br />streets, private utilities, and other common areas and facilities on the site, including <br />all landscaping, soundwalls extending to the face of curb, and back-up landscaping <br />between the soundwall and face of curb on Stoneridge Drive and Dennis Drive. <br /> <br />b. The City shall be granted the rights and remedies of the association, but not the ob- <br />ligation, to enforce the maintenance responsibilities of the property owners associa- <br />tion. <br /> <br />c. The CC&R's for the project shall prohibit the parking of boats, campers, and trailers <br />on site. <br /> <br />d. The CC&R's shall give authority to the homeowners association to enforce the re- <br />quirement that private garages be made available for parking. <br /> <br />e. The homeowners association shall be empowered by the CC&R's to ensure that ga- <br />rages remain available for vehicular parking. <br />
