.

.

in connection with a future design review. Commissioner Wright supports the application with the
deletion of Conditions 3b and 3c.

Conunissioner Cooper feels Mr. Deri's view is minimal and has already been impacted by other
residences in the area. On the other band, if this lot is not subdivided, the owner could construct
another structure that could impair the Deri viewshed. Those buying lots on the outskirts of town
are not always guaranteed they will retain their views. Although he noted that staff bent over
backwards to consider the concerns of the neighbors, Commissioner Cooper disagrees with staff and
feels the R-1-40,000 zoning should be applied to this application without any other restrictions as to
house location, height or landscaping.

Commissioner McGuirk also concurs with the previous comments of the Commissioners and supports
the deletion of Conditions 3b and 3c.

Chair Barker is also in agreement and feels the 20 foot height restriction for a one-story house does
not make sense. She does agree that Mr. Deri has the right to express his opinions.

Commissioner Wright felt the Commission needed to discuss the bulb-out of the cul-de-sac. Mr.
Higdon stated the complication of this matter is that it is a private street and all property owners
would have to agree to pay for the reconstruction of the cul-de-sac.

Commissioner McGuirk motioned, seconded by Commissioner Wright, making the fmdings for
the proposed ml\ior modification to the PUD Development Plan and approve Case
PUD-91-15-2M, subject to the conditions listed in Exhibit B, with the following modifications:

Delete Condition 3b.
Delete Condition 3c.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Cooper, Lutz, McGuirk, Wright and Chair Barker
None
None
None

Resolution No. PC 96-78 was entered approving Case PUD-91-15-2M, as motioned.

c.
