<br /> <br />. <br /> <br />. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Charles Huff, 30 West Neal Street, represented the applicants. The applicants agree with the staff <br />report and conditions of approval. <br /> <br />Chair Barker inquired whether the conditions included the owners being signatory to any rental <br />agreement. Mr. Iserson noted this is not part of the conditions, but could be added at the direction <br />of the Commission. Chair Barker explained to Mr. Huff the condition specifies that the owner- <br />occupier must be signatory to any lease agreement on the secondary unit rentaL Chair Barker would <br />like to add this condition to the application. <br /> <br />Commissioner Wright asked where the secondary address numbers would be located. Mr. Huff <br />stated the address numbers would appear on the front fence. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Wright motioned, seconded by Commissioner Lutz, making the required use <br />pennit findings and approve Case UP-96-62/Z-96-218, subject to the conditions listed in Exhibit <br />B, with the following modification: <br /> <br />Add: The deed restriction be noted that the owner-occupier must be signatory to any <br />lease agreement. <br /> <br />ROLL CALL VOTE <br />AYES: Commissioners Cooper, Lutz, McGuirk, Wright and Chair Barker <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Resolution No. PC 96-77 was entered approving Case UP-96-62/Z-96-218, as motioned. <br /> <br />b. PUD-91-15-2M/MS-96-09. Nancv Montl!omerv <br />Application for a major modification to an approved Planned Unit Development to subdivide <br />a 1.58 acre parcel into two lots, .75 acres each, where the PUD requirement is for minimum <br />one-acre lots. The property is located at 3800 Trenery Drive. Zoning for the property is PUD <br />(Planned Unit Development) - LDR (Low Density Residential) District. <br /> <br />. <br /> <br />Mr. Iserson presented the staff report on the application for a major modification to an approved <br />Planned Unit Development to subdivide an existing 1.58-acre parcel into two lots, each lot being <br />approximately .80-acres in area, where the existing PUD requirement is a one-acre minimum parcel <br />size. The lot is located at 3800 Trenery Drive. Staff advised that in 1984 the Council approved a <br />major modification for the Pinn Brothers development and the subject parcel was rezoned to a PUD <br />district with a development plan. The parcel was divided into two lots, one acre and 1.58 acres. <br />The one acre lot was subsequently sold. The PUD conditions call for one-acre lots. The current <br />application would change the 1.5 acre lot into two lots. The lots would fall under the design <br />guidelines of R-l-40,OOO.
