MATTERS INITIATED BY COMMISSION MEMBERS <br /> <br />. <br /> <br />Commissioner Cooper advised that Hulls on Sunol Blvd. had a strong chemical odor, and inquired <br />if staff could request them to abide by City regulations. <br /> <br />Chair Barker advised that Fisher Court in Val Vista is in very bad shape and is need of repair. <br /> <br />Commissioner McGuirk asked staff to look into the Pan-Cal agreements. He remembers they would <br />repair any damage they caused to Forest Hill Road after they finished their construction project. The <br />road is deteriorating, and he feels it will deteriorate more through the winter. <br /> <br />Discussion of Del Valle Court gate issue: <br /> <br />Commissioner Wright stated he thought the gate should be reviewed in light of the old General Plan <br />because the new General Plan had not been approved when this issue was filed. The old General Plan <br />did not have the restriction against gated streets/communities. <br /> <br />Mr. Iserson stated the City Counsel has advised staff that these issues must be evaluated against the <br />new General Plan. He also said that other City departments were opposed to the installation of the <br />gate (police and service response issues). Staff suggested the residents put up signs indicating it is <br />a private street and cars will be towed. The Code is written such that a minor modification not <br />supported by the Zoning Administrator automatically becomes a major modification, and the City <br />Council is the only body who can waive the filing fee. Staff will look for a way to bring this <br />application forward if so desired by the Planning Commission. <br /> <br />. Commissioner Cooper feels that this is a special case and cannot be lumped in a discussion of gated <br />private streets in general. He feels this should be presented to the Council. He does not want to <br />make a precedence of changing the established procedures. <br /> <br />Mr. Higdon stated they are looking at other ways of making changes, narrowing the mouth of the <br />street, adding landscaping, making the street look less like a major street. Gates soon become <br />maintenance headaches. <br /> <br />The Commission asked staff to review the project and bring back proposals rather than making the <br />project a major modification. <br /> <br />8.
