He advised the building separation is <br />actually 21 ft., not the reported 25 ft. He also advised the actual length of the carport is 32 ft. and <br />the 14 ft. width is correct as previously stated. <br /> <br />Me. Ting is concerned about the grading. He stated his fence is starting to move and his gate will <br />no longer latch properly. He expects his neighbor to comply with the CC&Rs, as he himself is <br />complying, in an effort to protect himself and the neighborhood. He does not believe someone <br />should be denied in favor of another resident. <br /> <br />ln response to Commissioner Cooper, Me. Ting stated that Me. Zuffa had not previously shown or <br />talked to him about his plans. Further, in response to Commissioner Cooper, Mr. Ting does not <br />believe the City has been out to inspect the possibility of earth movement. <br /> <br />In response to Commissioner Dove, Me. Ting stated the trellis plan is not acceptable to him. <br /> <br />. <br /> <br />loAnn Matone, 894 Bonita Avenue, lives diagonally from the subject lot and stated she has followed <br />this development for seven years and was involved in the original planning for Shapell. She feels <br />that to modify the required 20 ft. separation will open the door for other developers to come and ask <br />for modifications. If approved, it must be very specific that it applies to only one side of the house. <br />Going from a 20 ft. separation to an 11 ft. separation is out of the question. From the street front, <br />the carport is really not noticeable, however, when looking at the house and street as a whole, the <br />house structure looks like it goes from fence line to fence line. <br /> <br />Me. Zuffa again apologized for the inconvenience caused. He asked for clarification from staff on <br />the setbacks. Measurement is made from the garage wall to the property line. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner McGuirk stated he admired the applicant admitting his wrongdoing, but he cannot <br />support the modification by mitigating the carport structure. He recommends the carport structure <br />be removed and start over by working with staff. He feels it does not fit into the neighborhood <br />and feels it cannot be mitigated. <br /> <br /> <br />Commissioner Cooper feels good will by the applicant was not demonstrated when he did not secure <br />the proper building permits or talk with the neighbor of the common fence line. He could not find <br />any structure in this neighborhood built this close. to the fence line.
