After considerable discussion, the motion was restated: Commissioner Dove motioned, seconded by Commissioner McGuirk, to approve Case Z-96-125 and V-96-13, subject to the conditions listed in Exhibit B, with the following modifications: Condition 86: revised seating arrangement for outdoor dining as provided by staff. *Condition 87: prohibit employee parking in the rear lot. Condition 8a: modify to allow decorative grille work only with no provision for planters. ROLL CALL VOTE AYES: NOES: ABSENT: ABST AlN: Commissioners Dove, Lutz and McGuirk Commissioner Cooper and Chairwoman Barker Commissioner Wright None Resolution No. PC 96-70 was entered approving Case Z-96-125, as motioned. *Original Condition 87 of staff was withdrawn. Chairwoman Barker motioned that a recommendation be sent to the City Council that the parking for Case Z-96-125 go forward and the in-lieu parking agreement be revised to include a restaurant use in the in-lieu fee calculation. No second was made. Commissioner Cooper motioned, seconded by Chairwoman Barker, that the City Council consider the high probability of at least one restaurant would occupy this building when deciding on in-lieu parking fees. MATTERS INITIATED BY COMMISSION MEMBERS Commissioner Cooper inquired about the design of the intersection at Foothill Road and Muirwood North and the short merge lane on the north side of the intersection; it seems to be an area for accidents with drivers trying to pass each other. Mr. Higdon will look at the intersection. He advised that the double lanes facilitate more cars getting through a green light.
