If a person comes forward during an amnesty period and needs a variance, staff must <br />still be able to make the variance findings or the project will be denied and need to be removed. <br /> <br />Commissioner McGuirk noted his opposition to the direction of discussion; he wants to maintain the <br />Planning Commission's flexibility. He feels their flexibility was being taken away. <br /> <br />Commissioner Cooper commented that the real estate disclosure laws will take care of a lot of these <br />illegal structures because when the property is being sold, these situations must be righted. <br /> <br />At this time, the Commission decided to take no action at this time regarding projects built without <br />City approval, however, they will try to be tougher in their decisions. <br /> <br />8. MATTERS FOR COMMISSION'S REVIEW <br /> <br />a. Future Planninl!: Calendar <br /> <br />On Staples Ranch project, Ms. Barker stated the Affordable Housing Commission does not want the <br />affordable housing portion to be the last phase built. <br /> <br />b. Actions of the Citv Council <br />There were none. <br /> <br />c. Actions of the Zoninl!: Administrator <br />There were none. <br /> <br />d. <br /> <br />Determination on whether a business where a customer makes his or her own wine shall <br />be considered to be similar to and classified the same as a "microbrewerv." <br /> <br />Me. Iserson presented the memorandum from staff on the request for a determination whether a <br />business where a customer would be making his own wine shall be considered to be similar to the <br />definition in the zoning code of a microbrewery. Staff referred this issue to the Planning <br />Commission. Recently the City amended the zoning ordinance to create definitions for <br />microbreweries and to allow them subject to certain standards. <br /> <br />In this case the applicant, Grapes 4U, would like to do something very similar for winemaking. <br />Staff felt more comfortable to have the Commission make the determination that for employees who <br />would be helping customers make their own wine and eventually take it home would be similar <br />enough to the definition of a microbrewery. Staff feels this type of business would have less of an <br />impact from an odor standpoint because there would be no boiling on site. Staff feels comfortable <br />to recommend the Commission make the determination that the wine making establishment is similar <br />to a microbrewery for purposes of the zoning code. <br /> <br />There was no public hearing, however, the applicant for Grapes 4U, Allan Wells, 2401 81. Helena <br />Dr., #6, Hayward, was present for any questions of the Commissioners. <br /> <br />Commissioner Dove inquired if the pressurized containers would present a fire hazard. Staff <br />commented that the Fire Department did not have any objections with the facility.
