Citv of Pleasanton <br />Application for a major modification to an approved Planned Unit Development (PUD) for <br />Hopyard Village Shopping Center, located at the northeast corner of Hopyard Road and <br />Valley Avenue, to prohibit the dumping of garbage and/or recycling materials prior to 8:00 <br />a.m. or after 7:30 p.m. in the areas in and around the 52-space eastern parking lot and <br />buildings located at 3059 Hopyard Road and 5725 and 5737 Valley Avenue. Zoning for the <br />property is PUD (Planned Unit Development) - CC (Central Commercial) District. <br /> <br /> <br />The appeal of the minor modification for PUD-85-10-5M has been withdrawn by the property <br />owner; therefore, the Zoning Administrator's approval of the minor modification is upheld. <br /> <br />d. UP-96-22. Ken Gooch <br />Application for a conditional use permit to place 10,000 yards of fill on an existing <br />property, located at 7530 Vineyard Avenue. Zoning for the property is PUD (Planned Unit <br />Development) - RDR (Rural Density Residential) District. <br /> <br />Mr. Swift presented the staff report on the conditional use permit application to allow the <br />placement of 10,000 cubic yards of fill on his property at 7530 Vineyard Avenue. There is no <br />development plan for this property at this time. The fill material would come from the Vineyard <br />Avenue project to straighten the "S" curve. The Municipal Code requires approval of a <br />conditional use permit to place grading material on the property prior to the approval of a <br />development plan. Actual development is in question until the General Plan is approved. <br /> <br />Staff is recommending the approval of this application. It is a cost-effective use of the land fill <br />from the Vineyard A venue project. Staff finds no negative impacts associated with the proposed <br />grading. Old fill material will have to be removed or treated as per the recommendations of a <br />soil engineer. Mr. Gooch is also proposing to build a berm to provide sound mitigation for the <br />future development, which is in conformance with the Vineyard Avenue area guidelines to not <br />construct sound walls. <br /> <br />Commissioner Wright inquired if Condition 8 applied to the fill project or the future <br />development. Staff advised the condition refers to the fill project. Staff also noted that any fill <br />involving a septic or leach field would have to be addressed. <br /> <br />Commissioner Barker asked about the final design of Vineyard Avenue. Mr. Swift stated <br />Vineyard will have a sidewalk on one side only. The actual sidewalk material has not been <br />determined. Discussion continued about the future design of the road and the placement of the <br />berm. Commissioner Barker would like to plan the berm adequately so that it would not have <br />to be moved at a later date. Mr. Swift advised that the placement of the berm is in conformance <br />with the location of the road. <br /> <br />Commissioner Cooper asked if there would be tree removal with this f11l plan.
