<br />< <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Judy Backer Gray, 530 Sycamore Road, represented the application for the proposed <br />subdivision. Ms. Gray noted her approval of the staff report and the conditions of approval, <br />and advised she is in favor of the removal of the stables when the future street is constructed. <br /> <br />Hoss Bozorgzan, 675 Marsala Court, and is the owner of the adjacent property at <br />488 Sycamore Road (parcel 10), inquired where the access road would be located. Staff <br />indicated for the speaker where the access road is proposed. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Hovingh stated he feels awkward that the present residents are splitting their <br />property and are not paying for any of the infrastructure expense. However, he will not <br />oppose the action. <br /> <br />Commissioner Wright motioned, seconded by Commissioner Dove, making the PUD <br />findings and recommending approval of PUD-96-04 to the City Council, subject to the <br />conditions of approval listed in Exhibit B. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Dove, Hovingh, McGuirk, Wright and Chairman Lutz <br />None <br />Commissioner Barker <br />None <br /> <br />Resolution No. PC 96-20 was entered recommending approval of PUD-96-04 to the City <br />Council, as motioned. <br /> <br />c. PUD-80-16-6M. Lamorinda Develonment and Investment <br />Application for a Planned Unit Development major modification and development plan <br />approval to allow the construction of a fast-food restaurant with a drive through, a <br />service station with a convenience store and car wash, and two future restaurant pads <br />located at 5050 Hopyard Road (Hopyard Road at Gibraltar Drive). Zoning for the <br />property is PUD (planned Unit Development) - I/C-O (Industrial/ Commercial-Office) <br />District. <br /> <br />Mr. Pavan presented the staff report on the application for a PUD major modification and <br />development plan approval to allow the construction of a fast-food restaurant, a service <br />station with convenience store and car wash, and two future restaurant building pads located <br />at 5050 Hopyard Road (Hopyard Road at Gibraltar Drive), The reason for the PUD <br />modification is becA\'5e the current development plan specifically prohibits any type of <br />drive-through or service station use, <br /> <br />PIann1ng Commission Minutes <br /> <br />Page 5 <br /> <br />April 10, 1996 <br />
