,.

.

.

.

.

A motion was made by Commissioner Barker, seconded by Commissioner Kumaran,
requiring the developer to pay the full cost for construction, according to minimum
standards, of "A" Street.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Barker, Kumaran, and Lutz
Commissioner Wright and Chair Cooper
None
None

Commissioner Barker noted that this Commission required Mrs. Lauer, a previous PUD
developer, to underground utilities for six homes in her development and, therefore, she feels
it is appropriate to require Greenbriar to pay the full cost of undergrounding the utilities along
the reconstructed a portion of Sycamore Road. Commissioners Kumaran and Lutz agreed.

Commissioner Wright commented he does not like utility poles and believe they pose a traffic
hazard. However, his main concern is that the intent of the NSSP was to maintain the rural
character of the area, and he believes the street-scape should remain unchanged. He also believes
it would be unfair for the City to require the developer to pay the full cost for construction of
"A" Street and also force them to pay for undergrounding the utilities. He recommends that no
undergrounding be required at all. Commissioner Dove agreed.

Chair Cooper noted that although he raised the issue of the developer undergrounding the
utilities, he agrees with Commissioners Wright and Dove that it would not be fair for the
developer to pay for the construction of "A" Street and for undergrounding the utilities.

A motion was made by Commissioner Barker, seconded by Commissioner Lutz,
recommending that the developer pay for the cost of undergronnding the utilities along the
reconstructed portion of Sycamore Road from Sunol Boulevard to the east, as recommended
by Staff.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Barker, Lutz, and Kumaran
Commissioner Wright and Chair Cooper
None
None

A brief discussion was held relating to the timing of off-site property acquisition and the
Commission stated that they support staffs recommendations.

Planning Commission

Page 11

December 10, 1997
