<br />5. MATTERS CONTINUED FOR DECISION <br /> <br />. <br /> <br />There were none. <br /> <br />6. PUBLIC HEARINGS <br /> <br />a. AP-97-06 (Z-97-127). Joe Brover <br />Application to appeal a condition of approval of an administrative design review application for <br />a child's play structure located at 6719 Corte Santa Maria. Zoning for the property is PUD <br />(Planned Unit Development) - MDR (Medium Density Residential) District. <br /> <br />This item was continued to September 24, 1997. <br /> <br />b. UP-97-55. Mary T. Hamster <br />Application for a non-exempt home occupation permit to teach swim lessons in a backyard pool <br />located at 1045 Riesling Drive. Zoning for the property is R-1-6500 District. <br /> <br />Mr. Iserson presented the staff report recommending approval of the non-exempt home occupation <br />permit, subject to the conditions of the staff report. He described the proposed use and hours of <br />operation. He noted that neighbors had expressed concern regarding potential noise, traffic, and <br />parking impacts. Staff has worked with the applicant and the neighbors in an attempt to address those <br />concerns by adjusting the hours of operation, restricting class size, and requiring the distribution of <br />a flyer which includes information regarding parking and appropriate procedures for arriving at and <br />leaving lessons. Mr. Iserson noted that staff feels that the concerns have been mitigated and that <br />swimming lessons are an appropriate activity in a residential area. He advised that a number of letters <br />which generally support the application have been received. <br /> <br />. <br /> <br />Mary Harpster, 1045 Riesling Drive, noted that the staff report contains her credentials, goals, <br />philosophy on safety around water, and willingness to cooperate and respect her neighbors and <br />neighborhood. She noted that she is in agreement with the conditions of the staff report, but <br />requested that the Planning Commission consider allowing lessons until 6:30 p.m. during the week <br />to give her more flexibility to teach in the evening, and allowing lessons to begin at 9:00 a.m. on <br />Saturday. She noted that her immediate neighbors are very supportive, and advised that she has a <br />letter of support from the Arak Court neighbor behind her residence. She noted that her own family's <br />use of the pool causes more noise than when she conducts lessons. She read a letter from the parent's <br />of a former student (Andy and Sarah Bryon) commending her on her lessons and thanking her for <br />teaching their children. Ms. Harpster advised that she wants to stay home with her three children and <br />providing swim lessons in her backyard pool allows her to do so. <br /> <br />Commissioner Barker asked the applicant if her own children are in the pool during the lessons. Ms. <br />Harpster advised that her children are in the residence with a sitter or her husband. <br /> <br />Commissioner Kwnaran advised that he visited the area and noticed that the four allocated parking <br />spaces were occupied. Ms. Harpster confirmed that her own cars are kept in the garage. He asked <br />if the 15 minutes between lessons is sufficient to allow the arrival and leaving of students, and if Ms. <br />Harpster had considered increasing this time to one-half hour.
