<br />PUBLIC HEARING WAS CLOSED <br /> <br />. <br /> <br />A motion was made by Commissioner Dove, seconded by Commissioner Lutz, making the <br />conditional use permit findings, and approving Case UP-97-541Z-97-203, subject to the <br />conditions listed in Exhibit "B.." <br /> <br />Commissioner Kumaran reported that he visited the location, and that prior to his visit he had <br />reservations about the visual impacts; however, after visiting the site, he feels comfortable with the <br />proposal. He noted that there are ways to mount antennas on a building to fit in with the architecture <br />of the building so that it is unobtrusive and that he suggested consideration be given to this method <br />in the future and he also mentioned that in many cities antennas were camouflaged as branches of tall <br />trees. <br /> <br />ROLL CALL VOTE <br />A YES: Commissioners Dove, Kumaran, Lutz, and Chair Cooper <br />NOES: None <br />ABSENT: Commissioners Barker and Wright <br />ABSTAIN: None <br /> <br />Resolution No. PC 97-73 was entered and adopted as motioned. <br /> <br />. <br /> <br />d. RZ-97-04. City of Pleasanton <br />Application to consider an amendment to Chapter 18.44 (Commercial Districts) and 18.88 (Off- <br />Street Parking Facilities) of the Pleasanton Municipal Code to change the regulations for <br />massage requirements to permit the administrative approval of small massage establishments <br />if certain criteria are met, to conditionally permit gymnasiums and health clubs which include <br />massage services in the Commercial Regional Districts, and to change the parking requirements <br />for massage establishments in the Central Commercial District. <br /> <br />Mr. Iserson presented the staff report recommending approval of Case RZ-97-04, subject to the <br />conditions of the staff report. He noted that the Planning Commission had directed staff to prepare <br />a Code amendment due to the large number of conditional use permit applications for massage <br />therapists which are routine in nature. It was determined that this type of use, with little or no impact <br />on the surrounding uses, could be approved administratively. Mr. Iserson advised that a parking <br />standard has also been included in the proposed standard conditions for the Code amendment. He <br />noted that proposals which do not meet the criteria would come before the Planning Commission for <br />approval. <br /> <br />Mr. Iserson advised that the staff report states that no clients are allowed within establishments after <br />9:00 p.m. He clarified this statement noting that it is the intent that the last appointment would end <br />at 9:00 p.m., and that people would be given a reasonable amount of time to leave the building. <br /> <br />Mr. Iserson reported that the Police Department and City Attorney's Office are working on an <br />amendment to another section of the Municipal Code regarding the Police Department's function in <br />reviewing backgrounds and other issues related to granting a massage therapist permit.
