Downtown Snecific Plan) and Planned Unit <br /> <br />Develonment (PUD-97-08 "Rav Street Villal!e") Trumark HomesJPine Street Pronerties <br />Applications for a Specific Plan Amendment (SPA) and a Planned Unit Development (PUD) to: <br />(1) modify the adopted Downtown Specific Plan land uses from Auto-Oriented Retail (Office <br />and Commercial Service, either floor) to Mixed Use (Office/Commercial and Residential); (2) <br />rezone the site from Commercial-Service (C-S) and Planned Unit Development - Commercial- <br />Service/Office (PUD - C-S/O) to Planned Unit Development - Commercial-Service/OfficelHigh <br />Density Residential (PUD - C-S/OIHDR); and (3) seek development plan approval to construct <br />an approximately 6,100 square foot office building with semi-subterranean parking and 30 <br />small-lot single-family detached homes. The approximately 3.2-acre site is located on the north <br />side of Ray Street at 65 and 73 Ray Street, adjacent to the Alameda County Transportation <br />Corridor. The Planning Commission will also consider the Negative Declaration prepared for <br />the project. <br /> <br />Ms. Watt presented the staff report recommending approval of Case SPA-97-02 and PUD-97-08, <br />subject to the conditions of the staff report and staff's memo dated August 13, 1997. Ms. Watt <br />provided history of the site and described the proposed rezoning and the project development. She <br />advised that one of staff's primary concerns with approval of this mixed use development was the <br />assurance that the office building would be constructed. She advised that in order to address this <br />concern a condition has been added that no residential building permits shall be issued until after <br />permits for the office building have been issued. <br /> <br />Ms. Watt advised that the proposed project is a good solution for a site which has been problematic <br />in terms of uses and potential development. She noted that the office use along Ray Street meets the <br />intent of the Downtown Specific Plan to continue Office and Commercial uses and that the proposed <br />office uses is limited enough in scope to ensure a quiet environment for existing and new residents. <br /> <br />In response to a question from Commissioner Cooper, Ms. Watt advised that no access from the site <br />to the Arroyo is proposed, as the property owner only owns to the top of bank. <br /> <br />Ron Winter, 5506 Sunol Boulevard, represented the application. He noted that uses for the current <br />zoning are not compatible with the existing neighborhood. He advised that a number of neighborhood <br />meetings and meetings with individual property owners were held regarding the development of the <br />property. He advised that the proposed project reflects the input from the neighbors and staff. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Mert Murray, 470 Mavis Drive, advised that he owns three properties adjacent to the project. He <br />stated that this project will improve the area and that he would like to see it built soon. He noted that <br />the existing site is a fire hazard. <br /> <br />Linda Lee Clark, stated that she owns the property located at 4183 First Street. She noted that many <br />improvements have been made to her property and she is glad to see this site will be developed. She <br />is in favor of the proposal.
