EXI-IIRIT B <br /> DRAFT CONDITIONS OF APPROVAL <br /> <br /> PAP-72/PDR-414, James Ervin <br /> 4473 Railroad Avenue <br /> January 4, 2005 <br /> <br />General Conditions: <br /> <br />1. Development shall be substantially as shown on the development plans, <br /> Exhibit "A," dated "Received October 1, 2004" on file with the Planning <br /> Department, except as modified by the following conditions. Minor changes to <br /> thc plans may be allowed subject to thc approval of the Planning Director if found <br /> to be in substantial conformance to the approved exhibits. <br /> <br />2. If signing for the development is desired, a comprehensive signing program shall <br /> be submitted to the Planning Director for consideration under separate application. <br /> <br />3. Thc project developer shall obtain a Building Permit from thc Building <br /> Department and any other applicable City permits for the project prior to the <br /> commencement of any construction. <br /> <br />4. The project developer shall pay any and all fees to which the property may be <br /> subject prior to issuance of building permits. The type and amount of the fees <br /> shall be those in effect at the time the building permit is issued. <br /> <br />5. This design review approval will lapse within one year from the date of approval <br /> unless a building permit is issued and construction has commenced and is <br /> diligently pursued toward completion or an extension has been approved by the <br /> City. <br /> <br />6. Prior to issuance of a building permit, the project developer shall pay the required <br /> commercial development school impact fee for the 768-square-foot retail addition <br /> as prescribed by state law and as adopted by the Pleasanton Unified School <br /> District. <br /> <br />7. The building permit plan check materials will be accepted for submittal only after <br /> completion of the fifteen (15)-day appeal period, measured from the date of the <br /> approval letter, unless the project developer submits a signed statement <br /> acknowledging that the plan check fees may be forfeited in the event that the <br /> approval is overturned on appeal, or that the design is significantly changed as a <br /> <br /> <br />
