CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 05-001 <br /> <br /> RESOLUTION UPHOLDING THE APPEAL OF CASE PAP-72, THEREBY <br /> APPROVING THE APPLICATION OF JAMES ERVIN FOR DESIGN <br /> REVIEW APPROVAL, AS FILED UNDER CASE PDR-414 <br /> <br />WHEREAS, James Ervin has applied for design review approval to construct a <br /> single-story retail addition measuring 804 square feet to the front of an <br /> existing residence located at 4473 Railroad Avenue; and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial), Downtown <br /> Revitalization, and Core Overlay District; and <br /> <br />WHEREAS, at its meeting of November 10, 2004, the Planning Commission, after <br /> having considered all public testimony, relevant exhibits, and <br /> recommendations of City staff concerning this application, denied the <br /> application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant <br /> submitted an appeal to the decision of the Planning Commission; and <br /> <br />WHEREAS, at its meeting of January 4, 2005, the City Council received a report from <br /> the Director of Planning and Community Development, together with a <br /> copy of the staff report to the Planning Commission, regarding this matter; <br /> and <br /> <br />WHEREAS, the City Council held a public hearing on January 4, 2005, at which time <br /> the applicant and other members of the public were offered an opportunity <br /> to present evidence regarding this appeal; and <br /> <br />WHEREAS after a review of the materials presented, the City Council made a finding <br /> that the project is consistent with the General Plan, the Downtown Specific <br /> Plan, and the Downtown Design Guidelines; and <br /> <br /> <br />
