Pedro's Restaurant and Cantina <br />Application for a conditional use permit to allow music (live bands and recorded DJ) and <br />dancing, and to extend the hours of operation at Pedro's Restaurant and Cantina, located at <br />5075 Hopyard Road. Zoning for the property is PUD (Planned Unit Development) - ICO <br />(Industrial, Commercial and Office) District. <br /> <br />Mr. Iserson presented the staff report on the application for a conditional use permit to allow music <br />(live bands and recorded DJ), dancing, and an extension of the hours of operation at Pedro's <br />Restaurant and Cantina, located at 5075 Hopyard Road. This site is zoned PUD (Planned Unit <br />Development) - ICO (Industrial, Commercial, and Office) District. <br /> <br />Pedro's occupied this site in 1995, previously having been the site of Fountains Restaurant and <br />Cantina. Up until this time, Pedro's has operated under the existing conditional use permit from <br />Fountains. The applicant's desire for music and dancing and an extension of operating hours has <br />necessitated a new conditional use permit. <br /> <br />As per staff memo from Jerry Iserson, the hours of operation are Monday and Tuesday, 11 am to <br />12 midnight; Wednesday through Saturday, 11 am to 2 am; and Sunday, 9 am to 10 pm. Two <br />hundred customers will be allowed in the bar/cantina area where the music and dancing will be <br />located. The restaurant will hold between 500 and 575 persons. The applicant will also be providing <br />three security guards during the music/dancing activities. Full food service would be available daily <br />until 12 midnight; appetizers would be available until closing in the bar/cantina. <br /> <br />Mr. Iserson discussed the dance club land uses in Hacienda Business Park (Sh-Boom and Cadillac <br />Ranch). There have been no complaints from either of these establishments from the residents in <br />or near the Hacienda Business Park, although there have been a few police problems associated with <br />"Teen Nights" at Sh-Boom. These problems have subsequently been resolved with no further issues. <br /> <br />Of concern with this application is the potential for noise impact. There are no residential homes <br />nearby; however, there are a few hotels, and staff would not want this proposal to impact the hotel <br />guests. Staff conducted noise tests at the restaurant. With the music playing at the proposed level, <br />staff was unable to hear music at a reasonable distance from the building with the doors closed. <br />Further, staff will continue the testing once the facility is in operation. When the music is playing, <br />staff will again take noise readings to ensure that the noise levels are within the Noise Ordinance <br />limitations (70 dBA at the property plane).
