CommissionJstaff were against the health club but are approving the 24 hour convenience store operation. Commissioner Cooper feels the Commission should not regulate alcohol sales in this case other than limiting the store hours to 6 am to 12 midnight. Commissioner Dove motioned, seconded by Commissioner Wright, making the conditional use permit findings and approving Case UP-97-03, subject to the conditions listed in Exhibit B, with the following modifications: Condition 11: Provide a five foot corridor along the southern wall to the rear of the store for direct access for trash removal. New Condition: Prohibit the sale of alcohol after 12 midnight. ROLL CALL VOTE AYES: NOES: ABSENT: ABSTAIN: Commissioners Dove and Wright Commissioners Cooper, Lutz and Chair Barker None None The Motion failed. ~ Commissioner Cooper motioned, seconded by Commissioner Lutz, making the conditional use permit findings and approving Case UP-97-03, subject to the conditions listed in Exhibit B, with the following modifications: Provide a five foot corridor along the southern wall to the rear of the store for direct access for trash removal. Property owner is to increase the size of the dumpster or add a second dumpster. Condition 11: Condition 16: Store hours shall be no earlier than 6 am and close no later than 12 midnight. Commissioner Wright noted that he voted for the application in order to allow the applicant to continue his business even though he does not agree with the conditions.
