<br />Mr. Moore states that the church agrees with aU of the conditions of approval except for portions <br />of Condition 4 (Mr. Moore incorrectly stated it was Condition 6). Condition 4 speaks to the <br />masonry walL It states the wall must be in and complete before the church can pull Phase III <br />building permits. However, that is beyond their control; the wall may be delayed a few weeks <br />before it is completed. Mr. Moore is concerned and would hate to have to hold up the Phase III <br />construction waiting for the fence contractor to finish the job. This issues has been raised with the <br />Tiffany Lane residents, and they don't seem to have a concern. Could the Condition be revised to <br />add some flexibility or to state that it is the church's intent to finish the wall before Phase III <br />construction? <br /> <br />Commissioner Lutz inquired if a performance bond would be a solution to the wall problem. Mr. <br />Moore did not feel the contract was a big enough job for the contractor to put up a bond or whether <br />it would actually work. <br /> <br />Jerry Loving, architect, noted the major developments that have occurred over the last 20 years; the <br />building of the Tiffany Lane townhomes on what used to be church property and the underpass <br />construction to Santa Rita Road. The master plan is essentially the same as what was envisioned <br />from the beginning. The master plan sanctuary has been scaled down from 800 persons to 650 <br />persons. The church's relationship with the high school has been successful. <br /> <br />The main sanctuary has been moved to the center of the site away from Del Valle Parkway. The <br />planners wanted to create a friendly, home-style look, tieing in with the old-town architectural <br />theme. The large front porch offers a welcoming feeling. Mr. Loving also advised they are in <br />approval with the conditions except as noted above by Mr. Moore and are ready to move this project <br />forward. <br /> <br />Tom McLaughlin, 1123 Tiffany Lane, is very pleased that the relationship between Tiffany Lane <br />residents and the church is moving in a positive direction. The church officials have been very <br />receptive trying to find a solution to the fence. The homeowners are sharing the cost of the fence <br />with the church. They want to have the entire landscape installed in case the project runs over <br />budget, in which case the landscaping may be deleted. If the fence is not concluded on time, they <br />would be willing to work with the church so they can begin construction on their building. They are <br />more concerned that everything is completed and the landscape installed before the rains begin next <br />fall. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Staff advised that Condition 4 language could be relaxed by saying that if the fence is not completed <br />by the time the church is ready to start construction, and as long as it is well under construction, it <br />would be subject to the Planning Director's review and consultation with Tiffany Lane residents. <br /> <br />Commissioner Cooper motioned, seconded by Commissioner Lutz, making the conditional use <br />permit findings and approving the design review and conditional use permit applications, <br />subject to the conditions of approval listed in Exhibit "B," with the following modification: <br /> <br />Planning Commission Minutes <br /> <br />Page 12 <br /> <br />February 26, 1997 <br />
